JCT Training – Terms and Conditions

  1. GENERAL
    1. The JCT website is the online catalogue for the display of JCT Training Courses and the content displayed does not constitute an offer to sell any Training Courses to the customer. By using the JCT website for the purpose of purchasing JCT Training Courses the customer agrees to these terms and conditions in their entirety.
    2. These terms and conditions and any document, message or email from JCT constitutes an entire agreement between JCT and the customer and both parties agree that neither party relied upon any other term, condition, undertaking, promise, assurance, representation, warranty, or understanding (whether in writing or not) of any other person relating to the supply of JCT Training Courses to the customer.
    3. JCT reserves the right to amend these terms and conditions at any time and without prior notice.
  2. DESCRIPTION OF PRODUCT(S)
    JCT Training Courses take the form of the following:
    1. Instructor Lead Training – where a delegate is required to attend a location where an instructor delivers the training.
    2. JCT Training Online - instructor lead training where the delegate attends via a live-broadcast webinar.
    3. Training Materials – supplementary materials included to support the Instructor Lead Training.
  3. BOOKING AND PAYMENT
    1. The booking and purchasing of JCT Training Courses are subject to the following:
      • The prices set out for the relevant Training Course on the website.
      • The purchase of the Training Course includes the granting of a non-exclusive, non-transferable license to use the Training Materials and other relevant documentation on the terms of such license, which is set out in clause 4.
    2. Payment for JCT Training Courses must be made by credit/debit card (Mastercard/VISA). Payment is taken at the point the order is submitted by the customer.
    3. All payments must be made in British Pounds Sterling.
    4. VAT invoices are downloadable by the Customer by logging on to their account on the JCT online store and clicking on ‘My Orders’.
    5. Once registration for a JCT Training Course has been successfully processed, the customer will be notified by email confirming their place, the name of the course and the course instructor, the course timing, and location.
    6.  JCT reserves the right to change the prices of JCT Training Courses at any time without prior notice. This will not affect customers who have already purchased JCT Training Courses at an agreed rate.
  4. THE LICENCE AND CUSTOMER’S OBLIGATIONS
    1. The customer and/or delegate may receive and possess the Training Materials associated with the relevant JCT Training Course purchased and to use such Training Materials in conjunction with the attendance of such course, as well as use such a record of information for the term of this license provided that only the delegate of the relevant JCT Training Course may make such use of them.
    2. Except as expressly set out in this licence, the customer undertakes (and the customer undertakes to procure that their employees or any other delegate attending a JCT Training Course on their behalf or on their account so undertakes):
      • Not to copy the Training Materials except where such copying is incidental or necessary for the purposes of completing the relevant JCT Training Course.
      • Not to rent, lease, sub-license, loan, translate, merge, adapt, vary, or modify the Training Materials.
      • Not to alter, or modify, the whole or any part of the Training Materials nor permit the Training Materials or any part of them to be combined with, or become incorporated into, any other materials.
      • To supervise and control use of any Training Materials and ensure that they are used by the customer, its employees, delegates and/or representatives in accordance with these terms.
      • To include the copyright of JCT on all entire and partial copies made of the Training Materials on any medium.
      • Not to provide or otherwise make available the Training Materials in whole or in any part, in any form to any person without prior written consent of JCT.
  5. CANCELLATION OF JCT TRAINING COURSES BY THE CUSTOMER
    1. Customers who have purchased to attend a JCT Training Course via the JCT website may cancel the course up to 14 days from when the purchase was made.
    2. Any refunds under clause 5.1 will be made in full within 14 days from receiving the cancellation notice.
    3. If the JCT Training Course is due to start within 14 days of when a booking is made, the customer’s legal right to cancel under clause 5.1 will not apply.
    4. If the customer decides to cancel their course after the 14 day period referred to in clause 5.1. has elapsed, but the course has not started, then the following administrative charges will apply:

    5. Any refunds made under clause 5.4 will be made within 30 days from receiving the cancellation notice.
    6. If the customer wishes to make amendments to their booking, for example, their contact details have changed, or they can no longer attend but would like a colleague to attend in their place, they can request changes by contacting JCT at stanform@jctltd.co.uk with their details, including: name, email address, course booked and order number.
  6. CANCELLATION OF JCT TRAINING COURSES BY JCT
    1. Circumstances may arise, whether beyond JCT’s control or not, where it may be necessary to change or cancel course dates, trainer, content, venues and prices from those published on the JCT website. Whilst JCT will make reasonable effort to ensure that the customer’s booking is transferred over to the next available opportunity when the course can be rearranged, JCT will not be held liable for any costs and/or losses incurred as a result of any such changes. If JCT is no longer able to provide a course, JCT will request that the customer returns (at JCT’s own expense) any course materials handed out in advance and will issue a full refund to the customer within 30 days of the notification of the cancellation of the course being given, or offer the customer an opportunity to rebook an alternative course.
    2.  JCT reserves the right to remove from any course, customers, their employees, or any other delegate attending a JCT Training Course on their behalf or on their account that fails to comply with its standard practices and procedures. JCT reserves the right to refuse enrolments and/or suggest alternative arrangements if it believes that it will not be in its best interests or of other participants and/or the individual concerned to be enrolled on one of its courses.
  7. PERSONAL INFORMATION AND DATA PROTECTION
    1. Customers must provide an accurate and complete name, postal address, contact telephone number and email address when booking or purchasing JCT Training Courses. JCT may refuse or cancel enrolment onto a JCT Training Course if these details are not provided. Customer details will not be used for any other purpose than for the running of JCT Training Courses and/or production of Training Materials.
    2. The majority of correspondence with and from JCT is conducted electronically using email and web-based protocols. Customer’s details will automatically be added to the JCT database for the purpose of administering the JCT Training Courses and related correspondence. Customer’s details will not be shared with any third party, unless requested by law or similar authority.
    3. Customers will have the option to opt-in to receive marketing, promotion, and/or information material in relation to JCT Training Courses at the point of purchase. Such material is separate from the communications required to fulfil the provision of JCT Training Courses that the Customer has purchased.
    4. JCT uses customer data in accordance with current Data Protection Regulations.
    5. JCT or any third party supplier does not store or keep record of customers’ credit/debit card details.
  8. INTELLECTUAL PROPERTY AND COPYRIGHT
    1. The content of JCT Training Course and Training Materials and the contents of the JCT website are JCT copyright. The contents may not be copied and republished in any format, whole or in part. This includes but is not limited to copying text, copying pictures, or video, copying images for use in brochures, websites or any other medium, copying review content (narrative, video or pictures), copying backgrounds, or any other content.
    2. The Customer acknowledges that that all intellectual property rights in the JCT Training Course content and Training Materials anywhere in the world belong to JCT, and that the rights in the JCT Training Course content and Training Materials are licensed (not sold) to the Customer, and that the Customer has no rights in, or to, the JCT Training Course content or Training Materials other than the right to use them in accordance with these terms.
  9. LIABILITY AND CONTRACTUAL OBLIGATIONS
    1.  JCT’s total liability for any loss or damage shall not exceed the price payable for a JCT Training Course, except in the event of personal injury or death at a JCT Training Course organised by JCT.
    2. JCT shall not be liable howsoever caused for indirect or consequential loss including but not limited to: loss of profits, loss of revenue, loss of goodwill, loss of data, failure to achieve savings.
    3. JCT shall not be liable for any failure to perform either in total or in part any obligations under these terms caused by events beyond JCT’s control (Force Majeure). Force Majeure includes but is not limited to an act of God, fire, act of government or state, war, civil commotion, insurrection, embargo, prevention from or hindrance from obtaining any raw materials or energy, sickness or other cause beyond its control.
    4. Information relating to JCT Training Courses and/or Training Materials, whether on the JCT website or in any form, is for the use of Customers and others at their own discretion. No liability will be accepted by JCT for the accuracy of any information or the consequence of its use by Customers or others.
  10. COMPLAINTS
    1. Any mistakes or complaints in respect of JCT Training Courses and/or Training Materials should be addressed to:

    2. All complaints will be acknowledged within 5 working days. Notification will be provided for the length of time estimated for resolution of any complaint.
